Craig Man and Edmund Ian were photographed holding hands on the mouse to go Psycho at Great America Park in California in August 2008, according to the complaint, filed Monday in Santa Clara County, the Supreme Court. Consider a pair of digital photos after the trip, but refused to buy it.
On the same day, his friend saw the same photo printed and displayed on the counter to another drive after someone added a bubble caption above their heads, which contain stain, the complaint said. Friend confiscated photos and handed it to his face and Yang.
Wendy Musell, plaintiffs attorney, said that people immediately went to Great America human resources managers, who were initially responsive to their concerns, but eventually stopped communicating with them by calling the lawsuit.
10-count complaint, which names Great America and its parent company Cedar Fair Entertainment Company alleges sexual harassment, discrimination, invasion of privacy and infliction of emotional distress park staff. He also accuses park negligence in its hiring and supervision of workers.
Musell said plaintiffs humiliated photo display.
"Mr. Yang was in the process of leaving, and it was very difficult for him to deal with this kind of ridicule on the basis of sexual orientation," she said Tuesday.
The lawsuit seeks unspecified damages and policy changes at the park.
"Even if there had been anti-discrimination policy, the staff were not adequately trained in the policy, there was no proper supervision, for this type of events are taking place", Musell said.
Great America representative Jim Stellmack said Tuesday that he had not yet seen the complaint, but argued that the managers of the park "will take appropriate action" to combat the situation.
"Park did not justify the action, and managers dealing with the appropriate employees engaged", Stellmack said. He declined to elaborate on what these actions, citing privacy in personnel matters.
